Religious practices and beliefs:

the brazilian legal system in the face of State interventions

Abstract

This work aims to discuss the interventions of the Brazilian State in the right to religious freedom, demonstrating how the Brazilian legal system, through its institutions, has acted in response to the restriction of religious practices. The study seeks to understand how these mechanisms ensure social coexistence, considering the great diversity of religions within Brazilian territory. The research adopted a qualitative approach, including a bibliographic review of official documents, such as legislation, doctrines, jurisprudence, and official websites related to the topic, identifying the State's interventions in religious practices that conflict with other fundamental rights. The results indicate that, although the right to religious freedom is broadly guaranteed, the State imposes restrictions when religious practices conflict with certain fundamental rights, highlighting the need to balance the right to religious freedom with other fundamental rights. It is concluded that violations of religious practices result from State interference and that further studies and dialogues are necessary to achieve balance and ensure a fairer and more equitable society, fostering harmony between the right to religious freedom and fundamental rights in political, legal, and social spheres.
